For authorized dealers, dealer pricing and applicable dealer policies are governed by the applicable Dealer Authorization Agreement.

Orders and Order Acceptance

Submitting an order or receiving an order confirmation does not necessarily constitute acceptance of an order.

Apollo ATVs reserves the right to:

  • Accept or decline an order;
  • Limit quantities;
  • Request additional information;
  • Verify billing or payment information; or
  • Cancel an order where necessary.

If additional information is required to process an order, we may contact you using the information provided with your order.

An order may be cancelled or modified if there is a pricing error, product availability issue, payment problem, suspected fraud, or other legitimate business reason.

Payments

Payments are processed through authorized payment service providers.

By submitting payment information, you represent that you are authorized to use the payment method provided.

Apollo ATVs may verify transaction and billing information when necessary to process an order.

Shipping and Delivery

For dealer purchases, shipping and risk-of-loss provisions may also be governed by the applicable Dealer Authorization Agreement.

Returns, Refunds and Cancellations

Return, refund, cancellation, and exchange eligibility is subject to the applicable Apollo ATVs policies and the terms provided at the time of purchase.

For authorized dealer purchases, the Dealer Authorization Agreement provides that sales are generally final and that returns, refunds, exchanges, cancellations, and buybacks are not accepted unless expressly approved in writing or otherwise required by applicable law.

For defective components covered by an applicable warranty, the applicable warranty terms will govern the available remedy.

Warranty

Apollo ATVs provides applicable product warranties according to the warranty terms associated with the product or purchase.

For authorized dealer purchases, the Dealer Authorization Agreement provides for a 90-day Powertrain Parts-Only Warranty covering qualifying defects in engine and transmission components, subject to the applicable exclusions and claim requirements.

Warranty coverage does not automatically include labor, diagnostics, installation, shipping, downtime, wear items, cosmetic components, misuse, neglect, abuse, racing, improper assembly or maintenance, unauthorized modification, accident, water intrusion, transportation damage, or other excluded conditions.

Please review the applicable Warranty Policy for complete warranty terms, exclusions, and claim procedures.

Safety and Proper Use

Apollo ATVs products must be operated responsibly and in accordance with applicable manufacturer instructions, warnings, safety materials, and applicable laws.

Customers and dealers are responsible for observing applicable age, safety, training, and operating requirements.

Certain Apollo ATVs products are designed for off-road use only unless otherwise specified by the manufacturer.

Users should follow all applicable safety instructions and use appropriate protective equipment.

Dealers are responsible for complying with applicable CPSC, ANSI/SVIA, labeling, age-verification, training, and safety requirements as described in the applicable Dealer Authorization Agreement and related compliance materials.

Intellectual Property

All content appearing on the Apollo ATVs website, including but not limited to:

  • Text;
  • Images;
  • Product photographs;
  • Videos;
  • Graphics;
  • Logos;
  • Trademarks;
  • Product specifications;
  • Page designs; and
  • Other website materials

is owned by or used with permission by Apollo ATVs, Universal 21 Star Inc., or the applicable rights holder.

No website content may be copied, reproduced, modified, distributed, republished, sold, or commercially exploited without prior written permission.

Apollo ATVs trademarks, logos, and other proprietary materials may not be used in connection with any product, service, website, advertisement, or activity that could cause confusion or imply unauthorized affiliation with Apollo ATVs.

Authorized dealers may use approved Apollo ATVs branding and marketing materials only as permitted under their Dealer Authorization Agreement.

Dealer Terms

Businesses purchasing products for resale may be subject to additional terms and requirements.

Authorized dealers must comply with the applicable Apollo ATVs Dealer Authorization Agreement, which may include requirements relating to:

  • Dealer qualifications;
  • Licensing and insurance;
  • Service capabilities;
  • Orders and payment;
  • Product handling;
  • Safety and CPSC compliance;
  • Product marketing;
  • Intellectual property;
  • Warranty handling;
  • Confidentiality;
  • Termination; and
  • Other dealer obligations.

Where applicable, the Dealer Authorization Agreement will govern the dealer relationship.

Confidentiality

Where Apollo ATVs provides confidential or proprietary business information to an authorized dealer, the dealer must maintain that information in confidence.

Confidential information may include dealer pricing, dealer data, supplier information, customer information, business methods, programs, and other proprietary information.

Confidentiality obligations applicable to authorized dealers may survive termination of the dealer relationship.

Indemnification

To the fullest extent permitted by applicable law, authorized dealers agree to indemnify, defend, and hold harmless Apollo ATVs, Universal 21 Star Inc., its affiliates, officers, directors, employees, agents, manufacturers, suppliers, and successors from claims, damages, liabilities, losses, costs, and expenses arising from or relating to the dealer’s operations, negligence, breach of the applicable Dealer Authorization Agreement, customer interactions, assembly, repairs, modifications, transportation, storage, warranty handling, or acts of the dealer’s employees or contractors.

Limitation of Liability

To the fullest extent permitted by applicable law, Apollo ATVs shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the website, products, services, or information provided through the website.

This may include loss of profits, downtime, business interruption, loss of business opportunity, or other consequential losses.

For matters governed by the Apollo ATVs Dealer Authorization Agreement, Apollo ATVs’ total aggregate liability is subject to the limitations stated in that agreement.

Some jurisdictions do not allow certain limitations or exclusions of liability. Therefore, some provisions of this section may not apply where prohibited by applicable law.

Termination

Apollo ATVs reserves the right to suspend or terminate access to the website or services where a user violates these Terms, engages in unauthorized activity, or otherwise uses the website in a manner that may harm Apollo ATVs or others.

Dealer relationships may be terminated in accordance with the applicable Dealer Authorization Agreement.

Upon termination of dealer authorization, applicable dealers must cease unauthorized use of Apollo ATVs branding, marketing materials, logos, and other proprietary materials.

Changes to These Terms

Apollo ATVs may update or modify these Terms & Conditions from time to time.

Changes will become effective when posted on this website unless otherwise stated.

Your continued use of the website after changes are posted constitutes acceptance of the updated Terms & Conditions.

We recommend reviewing this page periodically for updates.

Governing Law and Dispute Resolution

For matters governed by the Apollo ATVs Dealer Authorization Agreement, the agreement provides for binding arbitration under the applicable American Arbitration Association rules and California law.

The Dealer Authorization Agreement also contains additional provisions concerning dispute resolution, venue, jury trial waivers, and class or representative actions.

For consumer transactions, applicable laws and regulations will govern the parties’ rights and remedies.

Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by applicable law.

Failure by Apollo ATVs to enforce any provision does not constitute a waiver of that provision or any other right.
